Clarification on OSMF Applicability for Outsourced Development #9190
-
QuestionDear WiX Toolset Team, We would like to confirm the applicability of the Open Source Maintenance Fee (OSMF) in a specific scenario. We use WiX Toolset to build a product and generate revenue from that product. We pay the OSMF according to our organization size. For this product, we have outsourced the development work to another company. That company does not use WiX Toolset for any other projects and does not generate revenue from the product itself (they only receive payment for development services). In this case, does the outsourced company also need to pay the OSMF independently, or is our payment sufficient? Thank you for your clarification. Open Source Maintenance Fee

General OSMF questions are better served on the Open Source Maintenance Fee Discussions. First, I am not a lawyer, so use yours. :) If an outsourced company is work for hire, then they are essentially considered part of your company and do not pay the fee separately. If the outsourced company is an independent service provider developing installation packages services for their customers, then the OSMF probably applies to them. It sounds like your case is work for hire. |
